US Supreme Court ruling could reshape tariff authority

A ruling against the 1977 law may boost market confidence and encourage shipments amid prospects of importer refunds

US Supreme Court ruling could reshape tariff authority

The United States Supreme Court is expected to deliver a decision shortly on President Donald Trump’s authority to impose tariffs under the International Emergency Economic Powers Act (IEEPA) of 1977.

The outcome could have significant implications for trade policy and government finances.

Market analysts interpreted recent social media comments from Trump as signalling concern over an unfavourable judgment.

Experts believe that if the court invalidates IEEPA-based tariffs, sentiment in the market could improve and encourage cargo shipments due to potential refund opportunities for importers.

The National Retail Federation commented on Monday that “even if the tariffs are struck down, the administration is likely to seek to reinstate them under other trade authorities.”

This indicates that alternative mechanisms remain under consideration.

On Wednesday, US Trade Representative Jamieson Greer confirmed that the government could employ other measures to recover approximately $200 billion in tariff revenues should the Supreme Court reject the current legal basis.
