US executive order sets stricter customs enforcement requirements

New changes to customs enforcement in the US were announced on 3 June 2026, following the signing of an Executive Order aimed at strengthening oversight and compliance requirements.


The order directs authorities to implement reforms focused on importer accountability and the enforcement of trade-related obligations.


While the exact details of the changes are yet to be clear, the measures introduce revisions to the Importer of Record (IOR) framework.


Part of the changes are expected to redefine the classification of foreign importers based on specific organisational and operational attributes.


Additional obligations are set to apply to all importers. These include expanded reporting requirements covering identification details, organisational data, ownership disclosures, and information related to business affiliations.


The order establishes new compliance conditions through the introduction of a “good standing” requirement. This status will depend on an importer’s record of adherence to customs regulations and fulfilment of financial obligations. Entities that do not meet this requirement may face restrictions on conducting import activities or assigning representation.


Enforcement actions are also strengthened through revised penalty frameworks and updated mitigation standards.


The Executive Order further calls for broader oversight across parties involved in import processes, including intermediaries and service providers.


Implementation will proceed through further regulatory steps, with authorities expected to define detailed requirements and engage stakeholders before the measures take full effect.
