Starting on 3 June 2024, the European Union, Switzerland, and Norway are implementing a new pre-arrival customs cargo safety and security programme using an information system called the Import Control System 2 (ICS2).
All sea freight shipments into or via the 27 member states of the EU, Switzerland, Norway, and Northern Ireland must comply with the new data filing requirements.
The ICS2 applies to all parties sending sea cargo from third countries to or through the abovementioned countries.
While this is a positive initiative to maintain trade security in the region, several trade groups - representing shippers, forwarders and vessel operators - expressed their concerns that failure to comply with ICS2 requirements may lead to delays, disruptions, and potential fines or penalties.
What are the requirements?
The system requires advance filing before vessel loading to facilitate risk-based customs controls and the free flow of legitimate trade across the EU.
Data is collected on all goods entering the mentioned countries in question before their arrival.
As of 3 June, economic operators carrying goods by sea and inland waterways and logistic providers will start filing maritime shipments with the states’ customs authorities.
Forwarders wishing to file directly to the EU customs authorities can do so from 4 December 2024 onwards.

How to comply with the new requirements
To facilitate the process for our customers, Kuehne+Nagel has set up its IT systems and processes to comply with the new requirements and submit the data directly to the states’ customs authorities.
